PROCEEDING OF THE MEETING OF ORISSA STATE COASTAL ZONE MANAGEMENT AUTHORITY HELD ON 12th APRIL, 2010

The 13th meeting of the Orissa State Coastal Zone Management Authority (OSCZMA) was held on 12.04.2010 at 10.30 AM in the NSAP Committee Room of Women and Child Development Department, Orissa Secretariat at Bhubaneswar under the chairmanship of Shri U. N. Behera, IAS, Principal Secretary, Forest and Environment Department. The list of Members present in the meeting is as per Annexure-I.
Shri Bhagirathi Behera, IFS, Director, Environment-cum-Special Secretary, Forest & Environment Department and Member Convenor of the Authority welcomed the Members and representatives of various projects to the meeting and explained the objectives of the meeting. Then Principal Secretary invited project proponents to deliver the presentations.


A. Project proposals for Environmental Clearance under CRZ Notification, 1991


1. Construction of Deep Draught Iron Ore and Coal Berth at Paradip Port.

Paradip Port Authorities have submitted a proposal for development of deep draught iron ore and coal berth on build own transfer (BOT) basis in Paradip port. This project, envisages construction of iron ore handling facilities for 10 million tones and coal handling facilities for 10 million tones per annum. The project includes two berths for handling ships of 125,000 DWT. The length of the berth shall be 370 meters long with 24 meters apron width to accommodate wharf based equipment and working space. The total cost of the project is Rs.1070.36 crores. The total project period will be 36 months. The proposed project area comes within the existing Paradip port area and comes under CRZ-III area as per CRZ map CZMP- 73L/II/SE Sheet No.45.
The proposal was placed before the OSCZMA in its meeting held on 4.3.2010. As decided in the said meeting, the representatives of project proponent presented the disposal plan for dredged material of Channel and Iron ore & Coal Berths. As reported, the capital dredging of channel would be completed by the month of June/July 2010. Out of 15.0 Million Cum. dredged material, 3.7 Million Cum. is used for beach nourishment and 11.3 Million Cum. for offshore sea dumping in 10-18m contour.  Whereas the dredging material of 4.0 Million Cum. to be generated from Iron ore & Coal Berths, 0.5 Million Cum. will be used for dumping in low lying areas and balance of 3.5 Million Cum. will be used for beach nourishment. The area for beach nourishment is along the north shoreline as dumping material in front of north seawall is added advantage to mitigate erosion & stabilize toe of seawall.
Since the status of forest land in the proposed project area was not verified by the proponent, they were requested to check with the revenue records. It was decided that in case there is no forest, a certificate to that effect may be submitted by the proponent to this Authority for consideration of the proposal in the next meeting. 

2.         Laying of transfer pipeline from North Oil Jetty to IOCL tank farm of PHBPL, Paradip.

M/s. Indian Oil Corporation Ltd. has submitted a proposal for laying of transfer pipeline from North Oil Jetty to PHBPL tank firm of IOCL – pipeline terminal at Paradip with the following activities:
i)          Providing two marine unloading arms controls at the jetty for transfer the crude oil from the tankers to the pipeline.
ii)         Laying of about 10 kms of pipeline from North Oil Jetty to existing tank farm of PHBPL.
iii)        HDD crossing of about 900 meters across the navigational channel.

The activity comes under CRZ-I, CRZ-II and CRZ-III area as per CRZ map sheet no. 40 CZMP.73L/12/NW, sheet no. 42 CZMP.73L/12/NE and sheet no. 45 CZMP.73L/11/SE. The total cost of the project is Rs.81.00 crores.
The representatives of proponent have presented their proposal before the Authority. The proposal was discussed in detail. Since the proposed activity i.e., conveying system through pipeline is a permissible activity as per Para.3.(2) (ii) of CRZ Notification, it was decided to recommend the proposal to Govt. of India for consideration of according Environmental Clearance under CRZ Notification, 1991.

3.  Construction of Single Point Mooring system and laying of crude oil transfer offshore and onshore pipelines from SPM to Tank farm of Paradip-Haldia-Barauni pipeline (PHBPL) at Paradip 

                  M/s. Indian Oil Corporation Ltd. has submitted a proposal for construction of single point mooring system and laying of three nos. 48” dia crude oil transfer offshore and onshore pipeliones from 2 nos. SPM to tank farm of Paradip-Haldia-Barauni pipeline (PHBPL) at Paradip. A total of 3.00 hact. of land is required for the said project out of which 1.1535 hact. of land comes under forest land.  The activity comes under CRZ-I and CRZ-III area as per CRZ map sheet no. 40 CZMP.73L/12/NW and sheet no. 42 CZMP.73L/12/NE. The total cost of the project is Rs.1492 crores.

The representatives of proponent have presented their proposal before the Authority. They intimated that they have already applied for forest clearance. After deliberation, it was decided to seek the following documents/information from the project proponent for consideration of the proposal in the next meeting.

    1. The oil spill disaster contingency plan should be prepared and vetted by the Indian Coast Guard Authority.
    2. Oil spill response and mitigation plan should be formulated based on the output of the spill analysis modeling carried out by NIO taking into consideration the simulated trajectories as the boundary for different scenarios.
    3. The project proponent should inform as to whether the cost of equipments, systems necessary as per the safety recommendations/ mitigation prescribed by NIO, Goa in their risk analysis report are included in the project cost.
    4. Considering the Eco-sensitivity of the area, as recommended by the NIO, Goa in their EIA report, the Environment Management Plan for the project should be formulated.  

4.  Construction of fishing harbour at Chandipur, Balasore
      
Deferred.

B.  Other Issues


5. Status of road from Hotel Hans Cocopalm to Hotel Sterling Resort, Puri.

The matter was discussed earlier and as decided earlier, the views of OREDA, ORSAC and Collector, Puri were sought. ORSAC reported that as per aerial photograph of 27.12.90, there is no distinct impression of road feature in the photograph in the area of interest nor interpretable from the said data. However, reports from OREDA and Collector, Puri are still awaited in spite of several reminders.
Additional Director, Town Planning made a brief presentation on this issue. After detail deliberation, it was decided to remind the Collector, Puri and Chief Executive, OREDA to furnish factual report in the matter early. 


6.  Modification of Building Regulation for construction in CRZ-II area at Puri and Gopalpur.

Housing and Urban Dev. Department has submitted a proposal for change of norms regarding ground coverage and maximum height of buildings in CRZ-II area at Puri and Gopalpur. As per present practice of building construction, maximum 33% ground coverage and maximum height of 9 meters are being considered by the PKDA for granting permission in CRZ-II area of Puri. Representative of H&UD Department have presented the proposal for change of Local Town/ Country Planning Regulations including Floor Space Index/ Floor Area Ratio for Puri and Gopalpur urban areas.
Govt. of India in the Ministry of Environment and Forests has already clarified in their letter No.J.17011/13/99-IA.III dated 9.12.1999 that in CRZ-II area, the FSI/ FAR norms should be followed as existed on 19th February, 1991. After detailed deliberation on this issue, it was decided to seek clarification from H&UD Department on building regulations/norms of Puri and Gopalpur development Authorities as existed on 19th February, 1991 including the Floor Space Index/Floor Area Ratio.


7.  Demarcation of imaginary line between two authorized structures

PKDA has requested OSCZMA for demarcation of the imaginary line between two authorized structures with reference to CRZ norms for approval of proposed Mayfair Hotel at Puri. As per clarification received from Govt. of India vide their letter dated 15.12.2008 that construction at the proposed site could be taken up on the landward side of the imaginary line  when drawn between the seaward boundary of the existing authorized constructions located in the abutting plots. Accordingly imaginary line has been drawn by ORSAC.
While approving the said imaginary line drawn by ORSAC, it was decided that geo-reference of the endpoints of the imaginary line on the plot in question must be put by ORSAC before returning the maps to PKDA for further action.
